These Terms and Conditions for the use of the online store www.viowedding.com apply to orders for the purchase of products/services offered by VIO CLOTHES SRL through the website.
For proper use of the website, we recommend that you carefully read these Terms and Conditions. We reserve the right to amend these provisions without prior notice.
- GENERAL PROVISIONS
This website is owned by “VIO CLOTHES” SRL. This document represents the public offer of SRL “VIO CLOTHES”, hereinafter referred to as the “Contractor”, addressed to any individual or legal entity placing an order on the website www.viowedding.com, hereinafter referred to as the “Customer”.
Use of the website implies acceptance of the Terms and Conditions proposed by VIO CLOTHES SRL, in accordance with Law No. 284/2004 on Electronic Commerce. The relationship between the Customer and the Contractor is established on the basis of Law No. 105/2003 on Consumer Rights Protection and other normative acts adopted in accordance with it. The Contractor reserves the right to amend these Terms and Conditions, and the Customer is required to monitor such amendments.
By placing an order and ticking the box “I accept the Terms and Conditions”, the Customer expresses full and unconditional agreement with the clauses of this Agreement.
- SUBJECT MATTER OF THE AGREEMENT
2.1. The Contractor undertakes to make to order, based on the specifications selected by the Customer on the website (or confirmed through the communication channels), a bridal/wedding dress (hereinafter referred to as the “Product”), and the Customer undertakes to pay the established price and receive the Product.
2.2. Considering the nature of the Product (made to order according to the Customer’s individual specifications), this legal relationship is governed by the rules on works contracts (Arts. 1352–1374 of the Civil Code of the Republic of Moldova) and the rules on distance contracts.
- PLACING THE ORDER AND CHECKING AVAILABILITY (FORCE MAJEURE / STOCKS)
3.1. After selecting the model, entering the measurements/specifications and making the payment, the order is registered in the system.
3.2. Verification procedure: due to the specific nature of the materials (special lace, handmade appliqués, crystals, imported fabrics), within up to 3 (three) business days from placing the order, the Contractor checks the availability of all elements necessary to create the ordered model.
3.3. If all elements are available in stock, the Contractor validates the order and automatically begins its execution.
3.4. Cases of unavailability (force majeure/out of stock): if a certain element (fabric, accessory, embroidery, etc.) is out of stock or cannot be provided for reasons beyond the Contractor’s control (major logistics delays, production stopped by the supplier, force majeure), the Contractor will contact the Customer by e-mail or through WhatsApp within up to 7 (seven) business days from placing the order.
3.5. In the notification provided for in item 3.4, the Contractor will propose suitable alternative options for the respective order (similar materials, adapted design, etc.):
3.5.1. If the Customer accepts the alternative: the production process continues under the newly agreed conditions, which become an integral part of the order.
3.5.2. If the Customer DOES NOT accept the alternative (or does not provide a response within 3 days), THE ORDER IS CANCELLED, and the Contractor fully refunds the amount paid by the Customer to the account from which the payment was made, without penalties or deductions.
- PERFORMANCE AND DELIVERY TIMES
The total time for the production of the Product and delivery is up to 90 (ninety) calendar days and is divided into the following stages:
Production stage (manufacturing): It lasts approximately 30 – 60 calendar days. This stage begins to run from the moment of confirmation of the availability of all details/materials (or from the moment of acceptance of the alternative by the Customer, according to point 2.5.1.).
Delivery stage: It lasts up to 30 calendar days from the completion of the production of the Product.
4.2. The entire process is transparent, and each stage (completion of production, shipment) will be discussed and confirmed with the Customer through the established communication channels (E-mail/WhatsApp).
4.3. Any address can be chosen for delivery – home, office or any other address, without additional payments. Only one delivery address is accepted for each order. If the order needs to be delivered to different addresses, then a separate registration of orders is made for each separate address.
Receiving the product:
In the case of product delivery, the Customer is obliged to make a video recording of the unpacking and checking of the product and to send the respective recording to the Contractor on the day of delivery. If within 48 hours of receiving the package the Customer does not send a written complaint on WhatsApp/E-mail accompanied by photos and a video recording, the product is considered received in perfect condition, the delivery-receipt act being considered tacitly signed.
Upon receipt of the products, in the presence of the courier, check the integrity of the packaging, the presence of the tax receipt. Any subsequent claims regarding these aspects will not be accepted.
- PRICE AND PAYMENT METHOD
5.1. The price of the Product is the price indicated on the website at the time of placing the order and includes all taxes applicable in the Republic of Moldova, except for delivery of the product to another country — in this case, payment of customs duties is the responsibility of the Customer. The delivery cost is indicated separately depending on the destination.
5.2. Payment is made online, in full, through the secure payment methods integrated on the website at the time of placing the order. Orders may be paid by payment card — upon receipt of the order, you will receive the fiscal receipt confirming the payment. Online payment is made under maximum security conditions using a payment card as the payment instrument, which allows online transactions. After making the payment, the Customer will receive a payment confirmation at the e-mail address.
5.3. The payment processor uses a secure system based on the latest version of the 3D-Secure security standard, which means a new global approach to buyer authentication in secure online transactions. This security measure involves redirecting the user, at the time of payment, to a secure maib page, where each cardholder is authenticated by assigning a one-time code for each online transaction.
5.4. Refunds are made only to the payment card used for the purchase.
5.5. To make a payment, you will need to enter your bank card details. The transfer of this information is carried out in accordance with all necessary security measures. The information is transmitted in encrypted form and is stored only on a specialized server of the payment system.
5.6. The following data will be requested in order to make the payment:
– Card number (16 digits)
– Expiry date (month and year)
– CVC or CVV code (3 digits)
– First name and last name on the payment card
5.7. If the card currency differs from the transaction currency (MDL), then the conditions of the issuing bank will apply when converting the amount debited from the card account.
- RIGHT OF RETURN / TERMINATION
6.1. Exception to the right of withdrawal/return: in accordance with the consumer protection legislation of the Republic of Moldova (Law No. 105 of 13.03.2003 on Consumer Rights Protection and Art. 1065 para. (1) letters a) and c) of the Civil Code concerning distance contracts), products made to order according to the consumer’s clear specifications or distinctly personalized (individual dimensions, design changes upon request) CANNOT BE RETURNED due to a change of mind, provided they comply in quality and dimensions with the confirmed specifications.
6.2. If the Product has manufacturing defects or serious non-conformities with the agreed model, the Contractor undertakes to remedy the non-conformities at its own expense within a maximum of 30 days from receipt of the complaint or, if remedy is impossible, to refund the value of the product.
6.3. The Customer submits to the Contractor any complaints regarding manufacturing defects or serious non-conformities with the agreed model on the day of receiving the product (on the day of delivery or signing the Handover-Acceptance Act).
6.4. The Contractor has the right to terminate the Agreement if a certain element (fabric, accessory, embroidery, etc.) is out of stock or cannot be provided for reasons beyond the Contractor’s control (item 3.4), and the Customer does not accept the alternative (or does not provide a response within 3 days) (item 3.5.2).
- COMMUNICATION AND NOTIFICATIONS
7.1. Official communication between the parties will take place electronically (remotely) through:
7.1.1. The Contractor’s e-mail
7.1.2. The Contractor’s WhatsApp/phone number
7.1.3. The Customer’s contact details: indicated in the order form.
7.2. Messages sent via WhatsApp or e-mail have full legal evidentiary force in case of misunderstandings/disputes.
- PERSONAL DATA PROTECTION
8.1. By using the website www.viowedding.com, you automatically agree to the collection and processing of personal data necessary for the processing/confirmation/execution of orders. Personal data is processed only for legitimate purposes, such as providing the products you order, promotions, Google Analytics, cookies and notifications/newsletter.
8.2. All information containing personal data is stored and used only for the period necessary to achieve the purposes for which it was collected and in accordance with the provisions established by Law No. 195 of 25.07.2024 on personal data protection.
8.3. The Contractor uses commercial security measures to prevent unauthorized access, maintain data accuracy and ensure proper use of the information on the website. Data transmission over the internet or a wireless network cannot be fully protected. Therefore, as with other companies, the Contractor cannot guarantee the security of the information provided by the Customer, and the Customer does so at their own risk.
